The building of the Tower of Babel was halted by a confusion of tongues. The specialization of the people concerned had become so high sophisticated, that the different technical terminologies could not be understood by the others anymore.
Also at present times in public works - and not only in them – too often conflicts take place during the realization of a new building between all the involved decision makers (professionals, investors, developers, builders, contractors, facility managers, supervisors, public administrators, suppliers…). In order to prevent all kinds of protests and claims an extensive body of rules and regulations has been created; this brings the need for the support of specialized coordinators and consultants, necessary from the first draft up to endless discussions, with more and more participants.
Still nowadays cost intensive approval procedures and long delays are very often the reason for bringing projects to collapse.
The new EU Public Procurement Directive 2004/18/EC introduces important changes in the procedures for the award of public works contracts, public supply contracts and public service contracts. During the Conference “Conflicts. Idea>>><<<Realisation” the “Competitive dialogue” procedure (article 29), the criteria for the award of the tender most economically advantageous (article 53) are some of the new rules brought by the Directive that will be analysed as a possible answer to the present critical situation on the market.
The application of the EU Public Procurement Directive 2004/18/EC according to the Austrian law will be also presented.
Law experts and experienced professionals will bring their vision on the changing in their specific fields and will point out new possibilities and risks.
